Having spoken with Joe Polcha at 9 Metro Tech, 3rd Fl. he said that they will require the receipts for the taken generators and $65 to recover each one. Anyone who goes has to show that they represent the people with the generators. Joe Polcha's direct number is 718 999-2533. 
ADDITIONALLY- as it is late, they advised me that there was little to no chance of getting them back before Monday.

UPDATE- Sgt. Wozniaki contacted me and told me that we need to speak to the NYC Law department and be 'guided by their directions'

This appears to be the relevant provision of the administrative code:

§   27-512   Fire  protection.  The  ground  enclosed  by  a  tent  or
air-supported structure, and the ground for a distance of at  least
ten feet outside  of  same,  shall  be cleared and maintained clear of
all combustible material or vegetation. No open flame of any kind
shall  be employed within the structure, or closer than twenty feet to
any part of the enclosure fabric. Fire extinguishing facilities shall
be provided in accordance with the requirements of chapter four of
this title.

ere is a portion of the draft memo the from Adminstrative Code committee, related to generators. (FYI, the rest of the memo will go out later today.)

 

  1. Administrative Code Provisions Concerning Gasoline and Diesel Generators
 

            The issue is whether OWS activists in Zuccotti Park may lawfully use a gasoline or diesel generator for electricity. In large part, the answer depends on the nature of the generator (gasoline, diesel, or other fuel) and the BTU input.

 

            As a general matter, a permit should not be required in order to operate a residential-sized gasoline or diesel generator, so long as the “BTU input or gross output [is] not more than one million BTU per hour.” AC § 24-121(a)(5).

 

            To enforce these regulations, the commissioner of environmental protection (see AC § 24-104(17)) or his or her designated agent (see AC § 24-105) is empowered to inspect any equipment covered under the Code where there is “reasonable cause to believe that any equipment or fuel is in violation of this code.” AC § 24-107(a). It is unlawful to interfere with or obstruct designated personnel in carrying out their duties, including any inspections or laboratory tests on the equipment. AC § 24-111.

Dozens of firefighters and police officers entered Zuccotti Park Friday morning to confiscate generators and gas canisters.
Fire trucks and police vans pulled up on the corner of Broadway and Liberty St. at about 8.30 am and asked the Occupy Wall Street protesters  to bring the items to them, saying they were a health and fire hazard.
"They made an announcement on a bullhorn saying: 'We are here to take  the generators, could you please bring them up to us on the corner of Broadway and Liberty Street'," said James Bennett, a member of the information working group.
When no one from Occupy Wall Street surrendered the generators, more than 20 uniformed FDNY and NYPD officials entered the park to seize them, witnesses said.
The protesters say five generators were seized in total, including one which was biodiesel and ran on used vegetable oil.
Several canisters were also taken, some empty, some with vegetable oil and one with gasoline, Occupy Wall Street say. No arrests were made and the incident was peaceful, the city said.

This is an inevitable but very striking example of US norm and behavior
proliferation and setting, and of the phenomenon of other countries
referencing US practice as justification for their own human rights
violations.

In other human rights contexts (e.g. recently, targeted killings), this
type of effect has occasionally been an influential advocacy point
against US practices vis-a-vis certain actors. Just something to keep
in the back of our minds as we continue to advocate here for our rights
to peacefully assemble and protest.
