this was my response from my attorney friend.

"You can file suit for anything, really, but it doesn't mean you'll be successful.  I doubt you'd be successful in a criminal action for theft.  You'd probably be more likely to prevail if you file a civil suit for conversion (assuming that the nypd/fdny attempts to keep the generators), but that's a slow process.  You'd need injunctive relief of some sort to get them back quickly.
 
Zucotti Park is privately owned, correct?  What are the rules that the park owners have provided OWS?"
